Privacy Policy
This privacy policy explains the nature, scope and purpose of the processing of personal data ("data") on our website and the associated features and content. Regarding the terms used, such as "processing" or "controller", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Terminology used
"Personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
"Processing" is any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers virtually any handling of data.
"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. "Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
Relevant legal bases
In accordance with Art. 13 GDPR, we inform you of the legal bases for our data processing. Unless stated otherwise in this policy, the following applies: the legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR; the legal basis for processing to perform our services and respond to enquiries is Art. 6(1)(b) GDPR; the legal basis for processing to comply with our legal obligations is Art. 6(1)(c) GDPR; the legal basis for processing to safeguard our legitimate interests is Art. 6(1)(f) GDPR.
Security measures
In accordance with Art. 32 GDPR and taking into account the state of the art, we implement appropriate technical and organisational measures to ensure a level of protection appropriate to the risk. These include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access, as well as procedures for exercising data subject rights, deleting data and responding to data risks.
Cooperation with processors and third parties
If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transfer it to them, or otherwise grant them access to the data, this is only done on the basis of a legal permission, because you have consented, because a legal obligation requires it, or on the basis of our legitimate interests (e.g. when using web hosts and the further service providers named below). Where we engage third parties to process data on the basis of a "data processing agreement", this is done on the basis of Art. 28 GDPR.
Transfers to third countries
Where we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or where this occurs through the use of third-party services (e.g. providers based in the USA such as Google), this only takes place where necessary to fulfil our (pre-)contractual obligations, on the basis of a legal obligation, or on the basis of our legitimate interests. Processing then takes place, for example, on the basis of special guarantees, such as an officially recognised determination of a data protection level equivalent to that in the EU (e.g. for the USA through the EU-US Data Privacy Framework), or on the basis of officially recognised special contractual obligations (so-called "standard contractual clauses").
Rights of data subjects
You have the right to request confirmation as to whether data concerning you is being processed, and to information about that data and further details in accordance with Art. 15 GDPR. Under Art. 16 GDPR, you have the right to request the completion or correction of inaccurate data. Under Art. 17 GDPR, you have the right to request prompt deletion of data concerning you, or alternatively, under Art. 18 GDPR, to request a restriction of processing. You have the right to receive data concerning you that you have provided to us, in accordance with Art. 20 GDPR, and to request its transfer to another controller. Furthermore, under Art. 77 GDPR, you have the right to lodge a complaint with the competent supervisory authority — the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstraße 219, 10969 Berlin, Germany.
Right of withdrawal and objection
You have the right to withdraw consent already given under Art. 7(3) GDPR with effect for the future. You may object at any time, under Art. 21 GDPR, to the future processing of data concerning you, in particular to processing for direct marketing purposes.
Cookies
"Cookies" are small files stored on your computer that may store information about your use of our website. "Session cookies" are deleted once you leave our website and close your browser; "persistent" cookies remain stored beyond that. Some of the third-party services embedded on this website (see below) set their own cookies.
If you do not want cookies to be stored on your computer, you can disable the corresponding option in your browser's system settings. Stored cookies can be deleted in your browser settings. Disabling cookies may limit the functionality of this website.
Deletion of data
Data we process is deleted or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this policy, data stored by us is deleted as soon as it is no longer required for its intended purpose and no statutory retention obligations prevent deletion. Under German law, retention periods of up to 10 years apply in particular pursuant to §§ 147(1) of the German Fiscal Code (AO) and 257(1) nos. 1 and 4, (4) of the German Commercial Code (HGB), and 6 years pursuant to § 257(1) nos. 2 and 3, (4) HGB (e.g. business correspondence, accounting records).
Contact form and guestbook (Formspree)
When you send us a message via the contact form or the guestbook form, the data you enter (e.g. name, email address, subject, message text) is processed to handle your enquiry in accordance with Art. 6(1)(b) GDPR.
The forms are technically handled via the service Formspree (Formspree, Inc., USA): your entries are transmitted directly to Formspree, temporarily stored there for forwarding, and sent to us by email. Formspree acts as a processor in this respect. For more information, see Formspree's privacy policy: https://formspree.io/legal/privacy-policy/.
We delete enquiries once they are no longer required; we review the need for retention regularly. Statutory retention obligations remain unaffected. Newly submitted guestbook entries are manually reviewed by us before publication.
Google Analytics
On the basis of our legitimate interests (Art. 6(1)(f) GDPR — analysis, optimisation and economic operation of our website), we use Google Analytics, a web analytics service provided by Google Ireland Limited or Google LLC ("Google"). Google uses cookies; the information generated by the cookie about your use of this website is generally transferred to and stored on a Google server in the USA.
We only use Google Analytics with IP anonymisation enabled. As a result, your IP address is shortened by Google within the EU/EEA beforehand; only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there. Your IP address is not merged with other Google data.
You can prevent the collection of your data by Google Analytics by downloading and installing the browser add-on available at https://tools.google.com/dlpage/gaoptout?hl=en. Further information can be found in Google's privacy policy: https://policies.google.com/privacy. Your data is automatically deleted after 14 months.
Google Calendar (availability overview)
To display the current availability overview, we embed a public Google Calendar via iframe on the "Book" page (provider: Google Ireland Limited or Google LLC). When this page loads, a connection is established to Google's servers, during which your IP address and technical information about your browser may be transmitted; we have no influence over the content or scope of this data processing by Google. The legal basis is our legitimate interest in a clear, up-to-date display of availability (Art. 6(1)(f) GDPR). Further information: https://policies.google.com/privacy.
Embedding third-party services and content
On the basis of our legitimate interests (Art. 6(1)(f) GDPR), we use content and service offerings from third-party providers on our website to embed their content, such as videos or maps. This always requires that the respective third-party provider perceives the user's IP address, as without it they could not send the content to the browser. The IP address is therefore necessary for the display of this content.
Vimeo
We embed videos from the "Vimeo" platform, provided by Vimeo Inc., Attention: Legal Department, 555 West 18th Street, New York, NY 10011, USA. Privacy policy: https://vimeo.com/privacy.
YouTube
We embed videos from the "YouTube" platform, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy policy: https://policies.google.com/privacy.
Live webcam (webcamera.pl)
On the „Misdroy / Miedzyzdroje“ page we embed a live webcam of the Międzyzdroje beach from the provider webcamera.pl (Grupa Marcode, Poland) as an iframe. When the page loads, a connection to the webcamera.pl servers is established, during which the user’s IP address may be transmitted for technical reasons. Google Maps
We embed maps from the "Google Maps" service (used, among other things, for the photo map and the directions page), provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Social media presence
We maintain a page on Facebook (www.facebook.com/ostseepanorama) to communicate with interested guests there. When visiting this external page, the terms of use and privacy notices of Meta Platforms Ireland Ltd. apply. No Facebook plugins or other social media widgets are embedded on our own website.
